Corruption risk analysis and implementation of proposals made therein

Corruption risk analysis is carried out by the Special Investigation Service. Corruption risk analysis in a certain field or process of state or municipal activity including the activities of Office of the Ombudsperson for Academic Ethics and Procedures (hereinafter Office) has not been performed.

Assessment of Corruption Risk Management

The assessment of corruption risk management is planned and performed in accordance with the Law on Internal Control and Internal Audit.

Anti-corruption assessment of draft legal acts

The Office of the Ombudsperson for Academic Ethics and Procedures does not draft any legal acts that would envisage regulation of public relations specified in Paragraph 1 of Article 8 of the Law on Prevention of Corruption of the Republic of Lithuania, so anti-corruption assessment of draft legal acts is not carried out.

Positions seeking which information about a person seeking that position has to be collected in accordance with Chapter Three of the Law on Prevention of Corruption of the Republic of Lithuania

According to Paragraph 2 of Article 17 of the Law on Higher Education and Research of the Republic of Lithuania, the ombudsperson for academic ethics and procedures shall be appointed by the Seimas (Parliament) for the term of five years on the recommendation of the Research Council of Lithuania. According to clause 10.1 of the Description of the Procedure for Provision of Information of the Special Investigation Service of the Republic of Lithuania about a Person Seeking or Holding Position at a Public Sector Entity, or about a Person whom Republic of Lithuania Delegates to a Position at the European Union’s or International Body approved by Order No. 2-231 of the Director of the Special Investigation Service of the Republic of Lithuania of 10 November 2021, the request for the Special Investigation Service to provide information about a person who is appointed to a position by the Seimas has to be signed by the Speaker of the Seimas or a person authorised by him or by the entity appointing the person to the position or a person authorised by him.

Report corruption cases

Pursuant to Article 9(1) of the Law on Prevention of Corruption of the Republic of Lithuania, an employee of the Office must report to the Prosecutor’s Office of the Republic of Lithuania, the Special Investigation Service or another pre-trial investigation institution of a criminal act of a corruptive nature known to him or her, except for an act which his or her close relatives or family members (the concepts of close relatives and family members shall be understood as they are defined in Chapter Two of the Code of Criminal Procedure of the Republic of Lithuania) may have committed, are committing or intend to commit, if he or she has received information that allows him or her reasonably to believe that the act has been committed, is being committed or is intended to be committed, and if there are no legal restrictions on the disclosure of the information to be reported.

Determination of the Level of Resilience to Corruption

The level of resilience to corruption will be determined once the Methodology for Determining the Level of Resilience to Corruption is approved by the Government.
